Krisztina Morvai’s Reply to Dr. András Földi

2008-12-01 09:08 barikád.hu

Dr. Miklós Király, Dean,
Dr. András Földi, Assistant Dean,
Faculty Members and Colleagues:

I have read in several Internet News Websites the open letter from Assistant-Dean András Földi, in which he states that for years he has been observing, with increasing anxiety, my actions and activities in the life of the community and my publications, which he considers to be exclusive and extreme.  He therefore proposes that, at its meeting on December 9, the Faculty Council adopt a resolution, which would appear to be a reaction to my „sins” and which would, among other things, state the following:

„The Council of the Faculty of Political Science and Law of the ELTE (Eötvös Lóránd University), cognizant of its ethical responsibility and duty,  takes this opportunity to declare that it condemns all forms of exclusive political extremism and hate against any group in the community.  It is unacceptable, even intolerable that any of our instructors (especially our qualified professors) display such conduct.  Any instructor, who regularly expresses extremist and exclusive views, who, apart from his tone and his style, is highly worthy of teaching at the University, does not belong in the community of university educators.”

I absolutely agree with Professor Földi: In the current crisis, in which Hungary finds herself, our Faculty has to take a stand on the important question of the conduct and code of ethics to be expected of the instructors of future lawyers.  In my view, the Oath of Jurists  outlines the principles, goals and values, according to which we should practice our calling as instructors.  We should prepare our students to conduct their profession in a way that is faithful and worthy of their oath as jurists.  Our primary responsibility is to prepare them for this and to act as an example for them.  Therefore, in regard to the expectations of the educators, it is appropriate to quote the applicable parts of the Oath of Jurists, which states the following:

„I swear that I shall always be faithful to the Constitution of the Republic of Hungary and to the Hungarian people (. . .).  In this time of celebration I pledge myself to the service of knowledge and truth, and I will make every effort to use my knowledge to promote the future of my fellow-man, my people and the glory of my country.”

It is obvious from the Oath that a Hungarian jurist may not display any conduct, and may not be indifferent to any manifestation, which conflicts with the interests of Hungary, that is the interests of the people and our constitutional values.  This means that our moral and professional responsibility to our students is to show an example, to raise our voices against any incident which would violate the independence of Hungary, which would be in opposition to the scale of values of democracy, at variance with constitutionality, human dignity and the respect for human rights.  Unfortunately, in Hungary, we have experienced such incidents regularly in recent years.

There was an incident, where people going home from a peaceful demonstration, a commemorative gathering of the opposition party, were „hunted down” by the hundreds, and were thrown to the ground and beaten, one after another, by the brutal actions of the police.  On the occasion of the 50th anniversary of our Revolution and Freedom Fight, in the course of one day, fourteen Hungarians were shot in the eyes, crowds of helpless citizens were thrown to the ground and beaten, and several hundred people were arbitrarily imprisoned and tortured with the methods of the Secret Police (AVH).  False accusations were brought against them, most of which were dropped in the course of a year but many of them are still awaiting a hearing.

Tragically, many of our colleagues in the legal system have taken an active part in all of this, acting as police officers, lawyers and judges, including many of our former students.  At the present time, there are efforts under way to restrict human rights (including civic and political rights and also economic, social and cultural rights), in legislation and implementation.   Both in the legislature and in the judicial system, we can read more and more frequently phrases that remind us of the arbitrary mentality of the fifties, which make a mockery of constitutionality.

At the same time, there is underway the selling out of the state, the acquisition of our natural treasures, our farmlands and our water resources by foreigners, and the squandering of the remainder of our national assets. From day to day, we can experience the systematic ruin of Hungarian entrepreneurs and farmers with the disregard for the rule of law and thus the rules and regulations for competition, as well as the stripping of employees of all their rights, shifting the enormous expense, caused by the deeply ruined, corrupt economic system, onto them, as the taxpayers.  Sadly, there were numerous jurists involved in this too, as legislators, writers of contracts, or as workers in the service of justice.  Up to the present, we have not taken a position as to how we should react to all this, what code of values we represent that we should pass on to our students at the Faculty of Law.  Professor Földi’s initiative could mark a turning-point and could put an end to the general indifference shown up to now.  I propose, therefore, that we begin a comprehensive discussion in the Faculty on the subject of the proposed „compass” for conduct, and I also suggest that there be some amendments to the planned resolution, which would bring about harmony between our directional standards, the scale of values of the Oath of Jurists and the scale of values which apply to the instructors.  Therefore, I propose that we debate the proposed resolution of Assistant Dean Földi, with the following modifications:

„Hungary has fallen into a crisis.  The basic constitutional values are in danger, that is, democracy, constitutionality, human respect and human rights, including the civic and political rights for freedom and the standard of living due to all people, which are their necessary economic, social and cultural rights.  Many of the national assets have been squandered; most of them are in the hands of individuals and in the possession of foreigners.  Hundreds of Hungarians have lost or will lose their employment and they will fall into a position that seems to be hopeless.  The irresponsible leaders of Hungary have placed the Hungarian economy at the service of foreign interests; the Hungarian entrepreneurs, farmers and workers have been rendered incapable; the Hungarian villages have from one day to the next been rendered non-viable.

Huge numbers of Hungarian people are subjected to increasingly aggressive punishment, turning them into victims by separating them from their property. The state does not fulfill its responsibility in preventing crime or punishing crime; instead the opposition concentrates the powerful police force, the physical and intellectual organizational sources to regulate the people exercising their right to assemble.

The Hungarian people have lost their collective rights that come from their human dignity, their (national) rights to self determination.  They have no say in the formulation of the fate of their country; they just have to submit to the decisions; they cannot take part in them or create them.

“The Council of the Faculty of Political Science and Law at the ELTE, cognizant of its ethical responsibility and duty, takes this opportunity to declare that it condemns all forms of exclusive political extremism”, especially

a.)   the withdrawal  of conditions of existence from the Hungarian people, meaning the arable land, the water and energy, which have been given into the hands of foreigners, the further privatization of the national assets, and the misappropriation of national assets in the hands of foreigners;

b.)   the systematic granting of profits with tax advantages and other advantages to foreign businesses to the disadvantage of the Hungarian enterprises, especially taking into account that this renders the Hungarian businesses incapable of competing with the foreigners, resulting in their failure and putting their families into poverty;

c.)  the continuous harassment of the small and mid-sized Hungarian enterprises, the arbitrary imposition of fines, rendering their operation impossible, their own state, the Hungarian state, treating them as criminals;

d.) the ruination of the Hungarian rural economy and the farmers, the prevention of the establishment and functioning of the family farmsteads, the freezing of the purchase prices,  the permission for the foreign chain grocery stores to establish themselves in large numbers in Hungary, the flooding of the Hungarian market with foreign goods of inferior quality, and the purposeful ruination of the Hungarian farmers;

e.)  the purposeful rendering the Hungarian villages incapable, the ruining of the villages, from the discontinuance of the processing of foodstuffs, through the closure of the small village schools, to the deterioration of the transport services; all these activities, whose obvious goal is to force people out of the villages into the cities, where, without roots and goals they will establish a new proletariat that can be manipulated;

f.)  the inhumane treatment of the Hungarian workers, the serious lack of labor-safety, the rendering of the trade unions and business federations incapable of functioning, the lowering of the wages and salaries to a humiliatingly low level and keeping them there, continually making it difficult for the workers to make a living;

g.)    all the points in section f. are presented as an absolute comparative advantage for Hungary and by so doing, they will turn Hungary into a third world colony;

h.)  that Hungary has been forced to adopt the global, bloodsucking economic and financial system, which is built not on the creation of value and honest work, but on speculation; it privatizes profits, but nationalizes losses, that is, it shifts the responsibility onto the little man, the retired people, the civil servants, those who are living on their wages and salaries.

The Council of the Faculty of Political Science and Law of the ELTE similarly condemns all forms of hate against any group in the community”, especially

a.)  anti-Hungarian hatred, the discrimination against Hungarians – exercised in their own country -- prejudicial discrimination in any form;

b.) beatings of Hungarians within and beyond the present borders of Hungary;

c.) the large-scale police brutality against Hungarians, official abuse, meaning mistreatment used against those exercising their civic and political rights (shooting out eyes etc.), arbitrary incarceration, torture, merciless, inhumane treatment, and the initiation of judicial actions with false accusations;

d.) official harassment and arbitrary police action against those who wear national symbols or have them in their possession;

e.)  the trampling of the Hungarian flag and other national symbols by numbers of police, accompanied by the use of the words „rotten Hungarians” or similar malicious expressions;

f.) the allowing of the actions in the points a-e to go unpunished, neglecting to find those responsible and bring them to justice, and the omission of the immediate and full reparation for the victims.

„It is unacceptable, even intolerable that any of our instructors (especially our qualified professors) displays such conduct – or tolerates with indifference any such conduct as is described in the points listed above.  Any instructor, who regularly acts in the manner expressed in the points listed above, who displays extremist and discriminatory behavior, who supports or takes part personally in such activities, or who acts as a jurist in such actions, or contrary to such conduct, displays indifference, either by commission or omission, who, apart from his tone and his style, is highly worthy of teaching at the University, does not belong in the community of university educators.”

Therefore, I respectfully request that the proposed resolution of Assistant Dean András Földi be presented to the Council of the Faculty, together with the above modifications and that it be given to every member of the Faculty (instructors and assistants) so that it may be debated by them.

Just as a reminder: In the autumn of 2006, there were four of us, members of the Faculty, who were members of the Association of Civil Jurists, which with its basic and detailed reports, uncovered the harsh violations of human rights and with these, broke through the wall of lies.  I wish to thank all our colleagues who helped us, who anonymously, in secret, often just in whispered communications „with secret messages”, with the most diverse conspiratorial methods helped our work with their professional advice or simply with their support.  I would very much like to see a time when we no longer need to whisper and conspire, and when we can work together in the interest of the protection of human rights and human dignity.

This is after all our Homeland.   This is our home and this is where we are at home.  We can no longer tolerate their threatening us and forcing us to work with whispers and secrets.  As jurists and as educators, we have a special responsibility to prevent the loss of the independence of Hungary, the further squandering of the assets, the loss of the Hungarian arable lands and natural treasures to the hands of foreigners, the further impoverishment of  the people and the deprivation of their rights and their dignity.  The cheated, abandoned, bitter, Hungarian people, driven out of power, out of the economy and from the narrow elite, are expecting our help, help from the jurists.  They trust that there is truth and truth will prevail.  We need to be such jurists and we need to raise such jurists who love their Homeland and who are able to feel the suffering of the cheated, tormented, defenseless people who have been deprived of their rights, and who bravely and determinedly stand beside us.

Respectfully

Dr. Krisztina Morvai

University Lecturer, Faculty of Political Science and Law

Post script: I request those colleagues, who agree with the goals of the proposed resolution, to join together and stand up for truth, for themselves and especially for the Hungarian people, who are deprived of their rights.  I urge them to join the professional association, where they can be in contact with colleagues who think along the same lines and to fight together for Hungary and for the dignity of the Hungarian people, for their rights „ to the last paragraph”.  This professional association is the National Legal Aid Society and its affiliate is the National Legal Aid Service.  Information about their work and the possibility of joining them can be found on their webpage: www.nja.hu

Sor került békés tüntetésekről hazafelé tartó emberek százainak „levadászására”, földrevitelére és véresre verésére, a legnagyobb ellenzéki párt emlékező gyűlésének brutális rendőri erőszakkal történő szétverésére. Forradalmunk és Szabadságharcunk ötvenedik évfordulóján egyetlen nap során tizennégy honfitársunkat lőtték szemen, földönfekvő, magatehetetlen és védekezésre képtelen polgárokat bántalmaztak tömegesen, többszáz embert börtönöztek be önkényesen, majd ÁVH-s módszerekkel kínozták őket, koncepciós eljárásokat indítottak ellenük, amelyek többségét közel egy év elteltével megszűntették, de egyesek még most is folynak.
Tragikus módon mindebben - rendőrtisztként, ügyészként, bíróként - aktív részvételt vállalt számos jogász kollégánk, köztük nyilvánvalóan egykori tanítványaink is.

A nemzeti vagyon nagy része elherdálásra került, magánkezekbe, nagyrészt külföldi tulajdonba jutott. A magyar emberek tömegei veszítették, vagy veszítik el munkahelyüket, s kerülnek reménytelennek tűnő helyzetbe. Magyarország felelőtlen vezetői a magyar gazdaságot idegen érdekek szolgálatába állították, a magyar vállalkozókat, gazdákat, munkavállalókat ellehetetlenítették, a magyar falvakat napról-napra életképtelenebbé teszik.

A magyar emberek elveszítették a méltóságukból fakadó kollektív jogukat, (nemzeti) önrendelkezési jogukat.

a, a magyar emberek alapvető létfeltételeinek megvonását, ideértve a termőföld, a víz, az energia külföldi kézre adását, a nemzeti vagyon további privatizálás, külföldi kézre juttatás általi hűtlen/hanyag kezelését, (elherdálását);
b, a multi illetve külföldi cégek szisztematikus előnyben részesítését adókedvezményekkel és egyéb eszközökkel a magyar vállalkozókkal szemben, különös tekintettel arra, hogy ez az érintett magyarok tömegeinek versenyképtelenné válását, tönkremenését, családok elszegényedését eredményezi;
c, a magyar kis és középvállalkozók folyamatos zaklatását, tevékenységüket lehetetlenné tevő önkényes bírságolását, saját államuk, a magyar hatóságok részéről bűnözőként történő kezelését;
d, a magyar mezőgazdaság és a magyar gazdák tönkretételét, a családi gazdaságok létrejöttének és működésének akadályozását, a felvásárlási árak leszorítását, a multi/külföldi élelmiszer áruházláncok tömeges letelepedésének engedélyezését, a silány külföldi áru Magyarországra ömlesztésével a magyar termelők tudatos tönkretételét;
e, a magyar falvak szándékos ellehetetlenítését, a falurombolást, ídeértve az élelmiszer-feldolgozás megszűntetésétől a falusi kisiskolák bezárásán át a közlekedés lezüllesztéséig mindazt a tevékenységet, amelynek nyilvánvaló célja, hogy a falvakból az emberek a városokba meneküljenek, s ott gyökértelenül, céltalanul egy manipulálható új proletariátust alkossanak;
f, a magyar munkavállalókkal szembeni embertelen bánásmódot, a munkajogi védelem súlyos hiányosságait, a szakszervezetek, érdekképviseletek működésének lehetetlenné tételét, a munkabérek megalázóan alacsony szintre szorítását és ott tartását, a munkavállalók megélhetésének folyamatos nehezítését;
g, az f, pontban foglaltak Magyarország kizárólagos komparatív előnyeiként történő feltűntetését s ezzel Magyarország harmadik világbeli gyarmattá válásának elősegítését;

a, a magyargyűlöletet, a magyar emberek kirekesztését, a velük szemben - a saját hazájukban alkalmazott – hátrányos megkülönböztetés minden formáját;
b, a magyarveréseket Magyarország jelenlegi határain belül s azokon túl;
c, a magyar emberekkel szembeni tömeges rendőri brutalitást, hatósági visszaéléseket, ideértve a polgári és politikai jogaikat gyakorlókkal szemben alkalmazott bántalmazást (szemkilövéseket stb.), önkényes bebörtönzést, kínzást, kegyetlen, embertelen bánásmódot, illetve koncepciós büntetőeljárások indítását;
d, a magyar nemzeti jelképek viselése vagy birtoklása miatti hatósági zaklatásokat, önkényes rendőri intézkedéseket;
e, a magyar zászló és más nemzeti jelképek rendőrök általi tömeges megtaposását, „rohadt magyarok” vagy hasonló gyűlölködő kifejezések használata mellett;

Ezúton is köszönöm mindazon további kollégák segítségét, akik név nélkül, titokban, sokszor suttogva, „rejtjeles üzenetekkel”, a legkülönbözőbb konspiratív eszközökkel segítették munkánkat szakmai tanácsaikkal vagy egyszerűen bíztatásukkal.
